Terms

Terms of purchase and use

Valid from [FYLL I: datum]

These terms apply when you create an account with Learnia and when you buy Premium or Test Season. We have tried to write them as clearly as possible. Please read them before you buy – you accept them at checkout. The Swedish version of the terms applies if the versions differ.

1. Who we are

Learnia is provided by [FYLL I: företagsnamn], corporate identity number [FYLL I: organisationsnummer], [FYLL I: postadress]. You can reach us at [FYLL I: kontakt-e-post].

The terms apply between you and us when you create an account, use the service or buy a subscription.

2. The service

Learnia is a web service for practising for the Swedish Scholastic Aptitude Test (högskoleprovet): practice questions in the sections of the test, timed test sessions, explanations and statistics on how you are doing.

Learnia is independent and has no connection with the Swedish Council for Higher Education (UHR), which is responsible for the test. The practice questions are written by us and are not UHR’s test questions. Information about your estimated score is guidance only – we cannot promise anything about your result on the real test.

3. Your account

Your account is created when you choose a plan on the pricing page – including the free plan. There is no separate registration. If you choose Premium or Test Season, you enter your email address at Stripe’s checkout; if you choose Free, you enter it in our form. We create the account and email a temporary password to the address. The first time you log in, you choose your own password.

If there is already an account with the address, we don’t create a new one. A purchase is then linked to the existing account.

You log in with your email address and password. The account is personal and may not be shared. Keep your password secret and tell us if you think someone else has accessed your account.

To buy Premium or Test Season you must be at least 18 years old or have the consent of a guardian.

4. Free account

You choose the free plan on the pricing page by entering your email address. It costs nothing and no payment card is needed. With the free plan you can take the level test (currently once a week) and answer a limited number of practice questions per calendar day, Swedish time (currently 3). Timed test sessions are not included. We may change what is included in the free plan.

You can take a short practice test on the website (Try without an account) without an account. The result is then only saved in your browser.

5. Plans, prices and payment

Premium is a subscription that costs SEK 199 per month, paid in advance. The subscription renews automatically at the end of each period and the same amount is charged until you cancel it.

Test Season is a one-time purchase that costs SEK 690. It includes the same content as Premium and is valid up to and including the next regular test day for the högskoleprovet according to the Swedish Council for Higher Education (UHR). If you buy Test Season less than three weeks (21 days) before a test day, it is instead valid up to and including the following test day. Test Season ends at midnight (Swedish time) after the test day, does not renew and does not need to be cancelled. The exact end date is shown on the pricing page and at checkout before you pay, and on the receipt. If UHR moves the test day, Test Season is valid up to and including the new test day.

Prices are in Swedish kronor including 25 % VAT. Payment is handled by our payment service provider Stripe. You can pay by card or Klarna, and Test Season also by Swish, depending on what is offered at checkout. We never receive your card details.

If we change the price of Premium, we will tell you by email at least 30 days before the new price applies, and the change only applies from the next period. If you don’t want to continue at the new price, cancel the subscription before then. A Test Season you have already paid for is not affected by price changes.

6. Cancellation

Premium has no lock-in period. You can cancel the subscription whenever you like under My subscription in the portal. The cancellation applies from the end of the period you have already paid for – until then you keep everything that is included. After that, the account switches to the free plan and nothing more is charged.

Test Season does not need to be cancelled: it ends automatically after the test day and the account then switches to the free plan. Paid periods and Test Seasons are not refunded afterwards, except when you use the right of withdrawal (section 7) or when the law gives you the right to a refund.

7. Right of withdrawal (14 days)

Under the Swedish Distance and Off-Premises Contracts Act (2005:59), as a consumer you have a 14-day right of withdrawal from the day the contract was concluded, that is, the day you bought Premium or Test Season.

Learnia is a digital service that opens immediately after payment. At checkout – and in the plan picker in the portal – we therefore ask you to expressly request that the service starts immediately and to confirm that you understand that, if you withdraw within 14 days, you pay for the part you have used. The consent also appears in the purchase confirmation we email to you.

If you withdraw from the purchase within 14 days, you pay for the part of the service you have used – for Premium in proportion to the paid month, and for Test Season in proportion to the time from the purchase up to and including test day – and we refund the rest. If you haven’t used the service at all since the purchase (no session has been started), you get the full amount back. The used part is rounded down to whole kronor. The right of withdrawal ends when the service has been fully performed, that is, when the paid period or Test Season has run out.

To withdraw from a purchase, use the “Withdraw from purchase” button under My subscription in the portal. There you see what you get back before you confirm, and you receive a confirmation by email. Access to the plan ends when you confirm. You can also email us at [FYLL I: kontakt-e-post] with your name, the email address of the account and which purchase it concerns, or use the Swedish Consumer Agency’s standard withdrawal form. We will refund you no later than 14 days after receiving your message, using the same payment method you used.

8. How you may use the service

The service is for your own learning. You may not copy, distribute or sell questions, explanations or other content, retrieve content automatically (for example with scripts or bots), or try to access parts of the service you don’t have access to.

If you break the terms, we may suspend the account. If a paid plan is suspended because of serious or repeated misuse, the remaining time is not refunded.

9. Intellectual property

All content in Learnia – questions, explanations, texts, design and program code – belongs to us or our licensors and is protected by copyright. You get a personal right to use the content in the service for as long as the account exists.

10. Operation and changes to the service

We aim for the service to always be available but cannot guarantee it. Sometimes we need to carry out maintenance. We develop the service continuously and may change, add or remove features. If we remove something essential that is included in your paid subscription, you have the right to cancel it and get back the payment for the remaining period.

11. Liability

We are not responsible for your result on the högskoleprovet or for decisions you make based on the service. Nor are we responsible for indirect damage. Nothing in the terms limits the rights you have as a consumer under the law.

12. Personal data

How we process your personal data is described in our privacy policy.

13. Changes to the terms

We may need to change the terms. We will tell you about significant changes by email at least 30 days before they apply. If you don’t accept the changes, you can cancel the subscription before they take effect.

14. Complaints and disputes

If you are unhappy, we would like to hear about it – contact us at [FYLL I: kontakt-e-post] and we will try to resolve it.

If we cannot agree, you can turn to the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, arn.se. We follow ARN’s recommendations. [FYLL I: bekräfta att företaget åtar sig att följa ARN:s beslut.]

Swedish law applies to the contract. Disputes that cannot be resolved by agreement are decided by a Swedish general court.
